Prosecutors Office Sends Letter to Attorney General on Develing Accident Case.

Philipsburg:--- The Prosecutor's office has sent a letter informing the Attorney General Dick Piar in Curacao of the findings involving prosecutor Jan Bart Develing and the traffic accident he was involved in on Saturday afternoon. Prosecutor Develing was arrested and spent almost six hours in custody shortly after the accident.
The letter was sent on Wednesday. Press Prosecutor Rienk Mud told SMN News that his office is still awaiting the police report from the police department regarding the accident which took place in the Middle Region. Mud said the only the reason the letter sent on Wednesday was because of the curfew on Monday and Tuesday due to the passing of hurricane Earl and tropical storm Fiona. Mud explained that the prosecutor's office also did not have electricity due to the hurricane and as such they were not able to communicate this information before. Mud said the Attorney General will take a decision on the course of action against his colleague Develing based on the letter that was sent to him.
Mud also explained that the attorney general has to be careful when taking decisions to sanction a federal officer of the law. Mud said no one can be suspended when there are no serious crimes committed and even though Develing is a public prosecutor he also deserves a fair trial.
The press prosecutor said his colleague Jan Bart Develing admitted to being involved in the traffic accident and he also gave his office the reason he drove away from the scene of the accident. According to Develing he was not sure if he was the main contributor to the accident or if it was someone who wanted to rob him. Mud said his colleague also said he took a split second decision to drive away from the scene simply because he was fearful and his intention was to call police the moment he got home which is not far away from the scene of the accident.
Mud further explained that based on article 9 of the traffic ordinance of the Netherlands Antilles gives a person 24 hours after an accident to report it to the police. However, Develing was stopped moments after he left the scene and was arrested by police. Mud also explained that Jan Bart Develing was not the traffic prosecutor some two years now and that he admitted to them and the police that he drank three beers prior to the accident and that was the reason police smelled alcohol on him at the time. He said the police conducted the sobriety test at the police station and they found that Mr. Develing was fit to drive. Mud also explained that the Dutch justice system does not have any other means to text drivers who are suspected of being under the influence of alcohol.
Apart from the letter that was sent to the attorney general by the prosecutor's office the police department has to continue their investigation into the accident. Mud said when the report is submitted to them they would have other colleagues outside of St. Maarten study the report and then they would decide if Prosecutor Develing will face prosecution for the offence he committed on Saturday. Mud said one of the reasons they have chosen to allow outside experts to study that report is to make sure Develing is treated fairly while justice is served.
Asked if the prosecutor's office was trying to cover up the case or if there is any type of class justice given to Prosecutor Develing, Mud responded by saying absolutely not and to avoid such accusations they have decided to send the letter to the attorney general so that he can decide on a course of action while they will also take other measures based on the police report.

So Mr. Mud is telling the Attorney general what to think:

If anyone was injured then leaving the scene of an accident is a serious crime Mr. Daveling. Three beers, hmmm.

How about an explanation as how the police could say he pa*sed a sobriety test when he was not able to stand on one leg?

Not convinced. I am already seeing signs of them accepting his feeble excuses as being indispuatable--smart fella, maybe not smart enough.

He said he ONLY drank 3 (one, then two, then three) beers. Guess he lost count after that.

He also used the excuse that he has a medical condition, reason why he couldn't stand on one leg during the test. Do the maths and add three beers to his medical condition and what you get? A wobbly one legged prosecutor in a hurry trying to get home. Does he have any letter from his doctor to back up his lame excuse?

I just wish the prosecutor could be as fast and as defensive for our "local" boys in blue.

Well i always have two drinks when I go out.
The first one and the last one. I can swear to that.
The first one when I get to the bar and the last one before I go home.
I don't believe I have to give account of any other drinks in between those two.
What is the fun in drinking if you have to count and report each drink you have.
No fun for me.

On another very serious note, I will print this letter and attach it to my dashboard.
Just in case a police officer doesn't remember that I have 24 hours AFTER the accident to report it.
What i have to find out is when does the count down start?
In fairness, it should start when I am made aware of the accident.
Maybe Mr. Mud knows different.
I hope he tells me

indeed, he is out to manipulate the Attorney's General mr. Dick Piar decision and thinking...after all Dick Piar is just another "inferior" local black man. Thus!.... they do that all the time with the dumb greedy politricians ruling the islands.

Luckily mr. Dick Piar speaks, reads, and writes fluent Dutch, and they way we, black police officers in Holland know him, he is not another **s licking modern uncle Tom.

To those SXM officers that arrested this jerk, we say, keep up the darn good work. Handcuff them also before putting them in the back of your car, because they are nothing more than the other black people they programmed you to think are always out to violate the rights of others.

Why do you people think they are in the Caribbean, because they are so skilled, and want to a*sist with blind justice for all?

you all should look up the laws before you all blablabla all over the place. The law gives you 24 hours to inform the police of an accident if you drove away.But if the police catch you within those 24 hours before you inform them you can be punish by law.Again for those who just like confusion. You have an accident and drove off, you have 24 hours to inform the police without been punish by the law, but if the police arrest you within those hours or after the the law can punish you for violating art. 9 traffic ordinance. Mud should of explain himself better to avoid all this confusion. And yes the prosecuter drove away andwas arrested by the police before he himself call it in so the law/judge not the police has to deal with him just like everyone else. Last but not least. I also find Develing reason given for driving away the biggest joke i heard ever, but a suspect has a right to lie or come up with a excuse .I guess being around so much suspect during his work, Develing has learn to lie and come up with a good excuse. Let us give him credit for that.

United States Senator Edward Kennedy had been drinking when he lost control of his car and went into the water. It was dark, he was drunk, and he couldn't see it was only six feet of water when he climbed onto land, walked home, told his family, and went to bed. The next morning the body of Mary Jo Kopechne was pulled out of his car. He pled guilty to leaving the scene of an accident. Sounds like Develing was lucky he didn't kill anyone THIS time.

You want to know why this prosecuter could come up with a lame excuse such as this one? We the SXM people gave him that opportunity. As a man of the law, he knows first hand the crime situation on this island. When the young lady was rapped weren't we here online saying if a car hit in to you we must continue driving because we no longer know now a days if it's a hold up or an honest accident? It's our own that has made this prosecuter come up with such a GREAT excuse and not lame. When you listen to the people in the community that's the advice being given if you are driving in dark areas and some one run into you. So our "good" prosecuter took his opportunity.

You seem to have knowledge. Let me ask if some is injured and you leave the scene of the accident. Do you still have 24 hours while the person is left in possibly life threatening situation?

Mr. Develing stated he has a medical condition. I never heard Mud mention that part in this well thought out defence of his colleague.

When the so called "blind" lady justice is out to get you, such as in the case of commissioner Derek Holiday who the wanted to replace with one of their own, as usual, they, the highest ranking police officer, the prosecutor(s), the judges of instruction, the judge with final say ALL sit together and plan their next move. Then they come out and perform, putting on a show for the media and general public...pretending that they want to reduce crime. They are the ones who are promoting crime using laws designed to protect the people for other means.

Cor Merx was not the first crooked prosecutor on SXM. There was another one before him who's name I just cannot recall. But he was there on the island doing numerous illegal things before, during and after hurricane Luis, and fled back to Holland when Curacao got some information about his doings. Nevertheless, here in Holland he was taken down.

Dear Editor:

Why was the suspect held as reported, for six(6) hours if there was no credible reason to hold him especiaaly in his position. Something is wrong, truly wrong! I wish some witnesses who saw what happened when he was detained will come out and give more details!

Yes, Oldenkamp was the crook!...thank you very much-above the law- those are the names of the nobody's in the Netherlands, no one ever noticed them when traveling in the bus, metro, tram, train, or peddling their rusty bikes to "work" who migrated to the Antilles and suddenly became revered experts, living in big houses, with a maid...while here in Holland all they had/have was/is a tiny 3rd or 4th floor rented apartment they themselves had to keep clean.

Dutch manufacturers/Commerce exports the best of their products to foreign countries in order to stay in business.
However, the best legal, commercial and medical minds are not exported. So, what do you think the Antilles/SXM gets, EXPERTS?

I agree with u also @ SXMER.. But what makes me sick is that they would use a situation like that something real that real people experience and get hurt... as their own excuse like it was some joke or something..
