PRO Soualiga filed Court Injunction against St. Maarten and Dutch State.

renatebrison31082020PHILIPSBURG:--- The Pro Souliaga established on St. Maarten has filed a court injunction today Monday in the Court of First Instance against the country St. Maarten and the Dutch State. Secretary for the  Pro Souliaga Renate Brison confirmed that the injunction was submitted on Monday morning.
Based on the court documents the Foundation is asking the court to prohibit St. Maarten and the Dutch State from using the Kingdom Charter to implement the Consensus Law and the Dutch Caribbean Entity.
The Foundation based its argument on three main factors and also determined that the Kingdom Charter in itself is invalid.
The court documents state that the United Nations has refused to declare 3 important points about the Kingdom Charter.
Those are:

1. UN refuses to state that the island exercise their rights to self-determination
2. UN refused to state that they (Islands) have achieved a full measure of government
3. UN refused to state that chapter 11 no longer applies the island.

The Foundation proposed that the Dutch Government establish a foundation on  St Maarten to carry out the task of the Dutch Caribbean Entity.
The Foundation Pro Souliga further indicated in their plea that article 73 of the UN Charter is the same as Chapter 11 (decolonization article of the United Nations Charter. Without the 3 statements from the UN, the islands are not decolonized and the Kingdom Charter and Kingdom itself are not in compliance with international law.
