DEN BOSCH /Netherlands:--- Construction company Janssen de Jong must continue to pay the salary of a suspected former director of a subsidiary in Sint-Maarten until his employment contract is definitively terminated. The judge in Den Bosch determined that in summary proceedings brought by Janhendrik Beokaar against the parent company with the head office in Son.
Janhendrik Boekaar was the director of Windward Roads, a subsidiary of Janssen de Jong in Sint-Maarten, until last year. Due to a major corruption investigation, the police invaded the office of Windward Roads in February 2018. Janhendrik Boekaar is one of the main suspects in the case. Under his leadership, money from the company would have been used, among other things, to pay a bribe. The prosecutor accuses him of bribing politicians, officials, fraud and money laundering.
Since the raid, the director was homesick and suspended. The shareholders of the Antillean company fired him this year.
The judge ruled that Janhendrik B. can still rely on his employment with Janssen de Jong.
The total damage caused by the corruption scandal has been estimated by Janssen de Jong to be at least 4.25 million euros. The company, therefore, considered it unacceptable that Janhendrik B. is still entitled to wages. The judge disagrees. Despite the suspicions, the former director is entitled to his generous salary until the judge has given a ruling in the case on the dismissal.
The dismissal case is scheduled for early October on St Maarten. However for de Judge to disagree there must be more to this case that the Supervisory Board must have known of all decisions made by the director Boekaar at that time.
