Central Bank accuses prosecution of confiscating documents not related to Tromp.

Documents that falls under the oath of secrecy now in the hands of the prosecution.

WILLEMSTAD/ ST. MAARTEN:--- In connection with the penal investigation against Mr. Tromp privately, the public prosecutor’s office conducted a house search on October 6th at the Central Bank of Curacao and St. Maarten (the Bank), on which occasion also much information was confiscated which falls under the oath of secrecy of the Bank and do not concern Mr. Tromp.
According to the law prior approval from the Common court of Justice is required for a house search and confiscation at the Bank. The legislator has made this a requirement amongst other because of the supervisory task of the Bank and to protect the confidentiality of information that has been submitted to the Bank including the information from financial institutions being under supervision. According to the opinion of the Bank the house search in question and the confiscation were conducted without the required approval. The Bank strongly objects to this.
The Bank considers it desirable, also for future reference, that in connection with the legal oath of secrecy that the court provides clarity on the legal requirements for a house search and confiscation at the Bank. For this reason the Bank has filed a complaint with the court of first instance. This complaint is expected to be dealt with by the court on October 31st.
Taking into consideration its oath of secrecy, The Bank emphasizes that it cooperates fully with the penal investigation against Mr. Tromp privately.
