territorialcouncil03112026MARIGOT, Saint-Martin:--- The Territorial Council will meet in plenary session on Friday, November 13, 2026, at 9:00 a.m. to consider a substantial agenda covering tax reform, infrastructure financing, public procurement, and a request for functional protection for President Louis Mussington.

The meeting will take place in the council’s deliberation chamber. The notice lists 15 proposed deliberations, followed by oral questions.

Tax Reform Framework on the Agenda

Council members are scheduled to consider adopting a tax reform framework and creating an associated committee. A separate item concerns miscellaneous tax measures.

The meeting notice does not detail the proposed changes, their financial impact, or which taxpayers would be affected.

The council will also consider its first budget amendment.

Two Proposed Loans Total €3.74 Million

Two financing requests would authorize borrowing totaling € 3,736,420 from the Caisse des Dépôts et Consignations.

The first is a €500,000 Territorial Cohesion Loan to finance the Maison des Associations in Grand Case.

The second is a €3,236,420 Ecological Transformation Loan for the Concordia multimedia library.

These are proposed borrowing authorizations. The agenda does not state the interest rates, repayment periods, or other financing conditions.

Functional Protection for Mussington

One deliberation concerns granting functional protection to Louis Mussington in his capacity as president of the Territorial Council, under Article LO 6325-8 of the French General Code of Territorial Collectivities.

The notice does not identify the circumstances behind the request, the assistance sought, or any potential cost. It therefore provides no basis for linking the item to a particular legal proceeding.

Executive Council Replacement and Procurement Ethics

Council members will consider replacing an Executive Council member. The agenda does not identify the outgoing member or the proposed replacement.

Several other items address public contract management.

These include adopting internal rules for the tender commission, the public service delegation commission, and the Collectivité’s selection juries.

The council will also consider an ethics charter and procurement policy for 2026–2028, along with a partnership agreement with SEMSAMAR on social inclusion clauses in public procurement.

Flag Adoption and Competition Rewards

The proposed adoption of the Collectivité of Saint-Martin’s flag is another major item.

Council members will be asked to approve its graphic charter and rules governing use, reproduction, and commercialization.

A separate deliberation proposes financial rewards for the three finalists in the flag design competition. The notice does not specify the amounts.

Staffing, Health Coverage and Maritime Land

The remaining proposals include creating permanent positions and amending the staffing establishment, as well as employer contributions toward supplementary health coverage.

The council will also consider removing a parcel from the Collectivité’s public maritime domain so that it can be incorporated into its private domain. The notice does not specify the parcel’s location, size, or intended future use.

Before the deliberations, ITSEE will intervene and provide information on an August 6, 2026 opinion issued by Saint-Martin’s Territorial Audit Chamber following a request from the accounting officer of the Lycée Général et Technologique Robert Weinum.

The session will conclude with oral questions.
