Prosecutor General Sends Develing on Leave Pending Accident Investigation.

Philipsburg:--- The Prosecutor General Dick Piar has ordered Public Prosecutor Jan Bart Develing to go on leave pending the outcome of the hit and run accident he had two weeks ago in Middle Region. Develing was also accused of driving under the influence of alcohol at the time of the accident and he was officially arrested and remained in police custody for about six hours.

Press Prosecutor Rienk Mud confirmed that Develing was sent on leave as of Monday this week, Mud said Develing was not suspended but was sent on leave as police prepares their report.

On Wednesday September 1, Chief Prosecutor Hans Mos sent a letter to the attorney general informing him of the incident Develing had with the police and the ongoing accident investigation.

In an earlier interview with SMN News Mud said that his office is still awaiting the police report from the police department regarding the accident which took place in the Middle Region.

The press prosecutor said his colleague Jan Bart Develing admitted to being involved in the traffic accident and he also gave his office the reason he drove away from the scene of the accident. Mud also admitted to his colleagues in the prosecutor's office and police that he had been drinking beers shortly before the accident but somehow he passed the sobriety test given to drivers suspected of being under the influence of alcohol.

According to Develing he was not sure if he was the main contributor to the accident or if it was someone who wanted to rob him. Mud said his colleague also said he took a split second decision to drive away from the scene simply because he was fearful and his intention was to call police the moment he got home which is not far away from the scene of the accident.

Mud further explained that based on article 9 of the traffic ordinance of the Netherlands Antilles gives a person 24 hours after an accident to report it to the police. However, Develing was stopped moments after he left the scene and was arrested by police. Mud also explained that Jan Bart Develing was not the traffic prosecutor at the time of the accident.

Apart from the letter that was sent to the attorney general by the prosecutor's office the police department has to continue their investigation into the accident. Mud said when the report is submitted to them they would have other colleagues outside of St. Maarten study the report and then they would decide if Prosecutor Develing will face prosecution for the offense.

Mr. Prosecutor can you inform me if this applies to everyone and in every situation. I've made a mental note of this and rest a*sured in the future someone will make use of what you have said.

That devil Prosecutor should be fired. Hit and run and drunk nota bene.
What more excuse he want to make, they want to rob him ? he should be given a ticket back to Deviland to Hol achter de koeien.

Mud has toned down his defense of Develing, but he still feels the need to point out Art 9. so Mr. Piar can be aware of the loophole.

Dick Piar, don"t let Mud ride over the top of you on this one. Give Develing a fair hearing and don't forget to ask to see his medical certificate for his leg problem that prevented him from standing on one leg during the so-called SOBRIETY TEST.

I will pin that ruling to my dashboard for future use if he gets away with it.

But I agree with previous bloggers: we SXMers allowed this to happen. They are simply using the corruption that exists all over the island to their advantage.

The law does state that you have to report to the police within 24 hours. But Mr. Mud forgot to inform the public that if you are caught within that time, you will still be arrested for hit and run and the 24 hour rule will no longer be in effect (correct me if I am wrong with article to back it up Mr. Mud).

If someone hit my car and I am suspecting that they are planning to rob me, I am not going home. They can follow me home and endanger my family as well. So I do not buy that excuse... but somehow Mr. Mud did.

And take note of this people. Do you see how Mr. Mud was quick to turn from public prosecutor to defense attorney? A good example why such cases must be handled outside of St. Maarten.

I think prosecutor Mud should be placed on leave as well for his remarks. He is untrustworthy and should not practice the profession anymore. St. Maarten is too small for people like him to be in that position. Very dangerous.

I can bet my last dollar he will lock away an innocent person for good just to defend one of his friends.

If this was you or me on st maarten, we would have been in court already. No investigation will be needed. See why we need an outside entity to over see the justice system on st maarten. and when we become coutry it will be worse.

TO TEST A PERSON FOR SOBRITY TEST THE ONE THAT TAKE THE TEST MUST BE APPOINTED TO DO THAT. I HEARD THAT DEVELING WAS TESTED BY THE CHIEF AND THE ACT CHIEF OF POLICE. SUCH A TEST THE TESTER MUST DO THAT IN THE PRESENTS OF THE PATROL OFFICERS THAT ARRESTED HIM.
IF THE TESTER HAD A SO CALL OPDRACHT TOT HET VERKLAREN VAN GESCHIKTHEID HAS TO BE PROVEN.

They say: Aruba prosecutors office will investigate the matter, thus will ensure a fair investigaton.
But when I looked further, I noticed that the chief prosecutor in Aruba is his (Develing's), good friend and former Boss in St. Maarten, mr Taco Stein!

Who are they fooling???
Is Justice really blind or are we so stupid we can not see!
