Appeal Court Ban Laviest from Public Office ---3 of the 5 charges not Proven—Court Rules.

laviestsupporters28012010Philipsburg: --- The joint court of appeals has thrown out three of the five charges brought against former commissioner of labour Louie Laveist. Laviest was convicted for accepting airline tickets to travel to Canada from BEMAL enterprises or BEMBO and $10,000 from said company, the court also found proven that Laveist accepted $6,000 from Bargains Unlimited which was paid to Culture Club foundation in exchange for working permits even though he had received a negative advice from the labour department.
The court found that Laveist had approached Bargains Unlimited for sponsorship for his foundation on December 7th and by December 10th the working permits for the company's workers were granted even though there was a negative advice.
The court convicted Laveist to six months suspended sentence with three years probation; he was also banned from public office for the next three years. The only way Laveist would serve his six month sentence is if he committed another crime within the next three years. Laviest also has to pay Naf.5000.00 or spend 55 days behind bars.
The appellate court also indicated in their ruling that the only reason Laviest received such a light sentence is because the investigating officers used illegal measures to obtain evidence against him.
Those illegal measures is the tapping the former commissioner's phone for at least two weeks as well as surveying his house and movement for the same period of time. The court said the investigators (Marachusees) violated the councilman's privacy. Tapping ones phone is a violation of ones rights based on the human rights charter. The court threw out the charges of forgery regarding the forging of the minutes of the Culture Club foundation for the purpose of defrauding AMFO of Naf 22,750. The court also found that the prosecution did not provide sufficient evidence to show that the barber shop in which Samuel Boney was working belonged to Laveist as such the charge of hiring an illegal worker was also thrown out.
In an invited comment Attorney at Law Cor Merx said right now Mr. Laveist should celebrate since three of the five charges were thrown out by the appeal court. Merx said in another week both him and his client would announce if they are going to appeal the verdict since they are still studying the verdict which was handed out late Thursday. The Laveist case is the first major criminal case Merx handled since he was sworn into the bar. It is clear that Merx managed to show the appeal court that the charges brought against Laveist were erroneous.
Should Laviest accept this conviction then he would have to resign from his seat as an Island councilman, which would definitely affect the current government. SMN News learnt that Laviest is already contemplating appealing the verdict even though it is in his favor. Efforts made to contact Laveist for a comment proved futile up to press time.

Louis, I prayed and prayed and then prayed that you would get rid of those charges. I am aware that you and your cohorts did do some shady stuff, but you have done nothing more than those scoundrels who tried to get you locked up. Patience is what you need to excersize right now. ROB will bring them all to a screeching halt. they running all over. they look like they planning to move to holland now. Don't worry those days you spent crying will be vindicated sooner or later. I am clearly happy to know that you wont be going to jail. Next time around you must not be giving away permits to your donors. You are clearly destroying the country with all this illegality, but I know you are a changed man. DP encourages corruption and you fell in the same trap. These are dangerous people. Appeal your case which would take another 2 years so stay put and let NA clean up the mess.

I am 100% sure he will appeal, if only to get more time to steal people's money while holding his public office.

NO prison time, what a joke. You will never stop corruption until you start handing out brutal unishment. Then maybe these gangsters in public office will get the message.

Did I read this correctly: At the very LEAST he got $6000 bribe, and was fined 5000 guilders, or $2800 ?

Sad, sad day in sxm, this is a veridct to show public servants that they will ban you from office for a while, give you a profit for your wrong doings, and make you a free man to start all over again. What a lesson learned !!!! Do these things only happen on sxm, i get the feeling that it does. Big time commissioner convicted for bribery with a slap on the wrist. What's worst someone taking the oath of public office and missusing his power for self enrichment, or the drug addict who breaks into my home to look for something to sell to satisfy his addiction?

The judges are being paid under the table guys. This was going on for years but the business is just getting better. Once paid, no jail time. It is teamwork by a group of top crooks in the OM and in govt.. They had to give him a fine or something to make it look good. They they decided and agreed on the amount. So no one is losing anything here. Ask De Vrieze or x-gov Richardson. They know the details how this works. While you at it, ask about Iranians businessmen coming here and buying over local businesses even thought they have no legal documents to do so. This is only the beginning.

@ MS. VOODOO. I love your comment, but you know what? You can try to educate and inform people but if they have a vale over their eyes they will never be open for sensible reasoning. They will forever stay backwards.

Loui and his supporters blames everyone else for his downfall but fail to realize he (Loui) caused his own down fall. When Boasman tried to advise him of the negative consequences issuing those 13 permits could have, Mr. Laveist blatantly decided to hell with locals getting jobs. He made a promise and would get rid of a local (Boasman) in order to collect his bribe money. (they were not the only ones). Loui left "local" business people sit and wait while his Vietnamese just walked in and went in to see him during the time he had to meet with the local business persons. Guess what? The locals had to shut their mouth and wait while they had made an appointment weeks before.

His (Loui's) stooges keep saying God does not sleep and God will do this and that but then they should realize that GOD has spoken. At a certain point GOD said, Mr. Laveist, enough is enough, it is going to end here and now. Boasman, the EXCO and others tried to knock some sense into his head but he had a debt to pay and would crucify whomever to get his precious permits.

I am also very concerned with the behavior of the new comm. of Labor. Up to now he has not made clear what his reasons are for wanting Boasman gone. This is the best the Labor office has been functioning in over 30 years. So what is wrong? Is it a power struggle thing? Is it a personal vendetta? Is it to live up to the promise made to Laveist for his support? Is Labor trying too hard to place locals in jobs? Or did he already make promises to businesses to issue permits? Boasman does not handle the intake of any requests for work permits, dr. cards, welfare, etc. The section heads and their staff do that. They review each request, put their advise, then meet with the "interim" Dept. head (Boasman). The file then goes to the Director then to the Comm. office then to the EXCO. Once a decision is made it is sent back to Labor to be issued. The sector heads deals with that also. So Mr. Commish, what is the problem here? Please don' be a Loui look alike.

This site isn't biased to Laveist only. I have seen many people be crucified on this site without any proof but RELIABLE SOURCES etc.
In this case though Laveist has ben convicted in appeal court by 3 judges on BRIBERY charges. The only reason he's not in jail is because the same appeal court found his privacy was invaded when they tapped his phone and followed him without getting the permits correctly. The permits were signed by the prosecutor general instead of the Lt. Governor. But mind you HE WAS CONVICTED, so in this case I don't believe he was convicted. I have seen this site support laveist in his move away from DP and his mother's doctor card affair when It was all a LIE. They never ran another story to correct the lie about his mothers dctor card so no this site has also protected Laveist. This time around he got convicted and it hurts but bear the cross for the crimes you committed and you did commit them.

The site doesn't have to correct the "LIE". Laviest said what he had to say at an Island Council meeting.... and the site placed it in a story.....don't blame the site for what came out of Laviest's mouth.....the media is not to blame for Laviest's situation.....he is Responsible for his own words and ACTIONS....
