William Blasts Roy in Westin Affair ---Says Former Commissioner of Tourism is being Hypocritical ---Auction Postponed.(UPDATED)

william17122009Philipsburg: ---- The island receivers would hold off its planned auction on Friday at the Westin Resort for the unpaid room tax dating back from 2004 to 2009 confirmed head of the Island Receivers Sherry Hazel. Hazel said she was informed early Friday morning that the lawyers managed to come to an agreement. She said Westin would put the monies owed to the island recievers in an escrow account pending the outcome of a court case which should be called within the next two weeks . "We would put off the auction until that court case is heard".

In the meantime, Leader of Government William Marlin is furious at the statements made by former commissioner of finance and tourism Roy Marlin on the Westin affair. Marlin said the current executive council the National Alliance/Heyliger and Laveist government has nothing to do with the letter of comfort given to Westin on March 11, 2005. Marlin said the Democratic Party Executive council had four years to change the room tax ordinance as they promised the Westin but that government did nothing to aid resort or to live up to their promise. According Marlin the former executive council had promised Westin to amend the room tax ordinance by mid 2005, which would allow Westin to qualify for a waiver on the room taxes. Marlin said the former executive council also made the same kind of promise to other resorts as well.
Marlin further explained that on November 6 2008 the Westin sent the executive council a letter regarding the so called letter of comfort and the Democratic Party Executive Council took a decision on January 22 2009 to write a letter to Westin notifying them that the executive council would not be able to honor the letter of comfort and as such they would have to pay what is owed to the island receivers office.
The letter he said states that the executive council has denied their request since the room tax ordinance remains unchanged therefore they would have to pay what is owed to island receivers.
Marlin said while a decision was taken by the former executive council on January 22 2009 that letter was sent to Westin on June 30 2009 creating the impression that this current government is involved in Westin demise.

Marlin said his government had absolutely no knowledge of the Westin's affair. He said that someone from Westin called him personally and requested answers from him after they received the letter. Marlin said it was then he asked Westin to provide the letter that was sent to them and he did some research to see what the actual problem was. Ever since then the current government has been trying to find a solution to the problem Marlin explained. According to the letter sent to Westin it states that the room tax ordinance is still undergoing revision, and the existing room tax ordinance makes no provision for the granting of exemptions and or waivers. It is also states that whenever the changes are made the Westin can apply for tourism incentives but that would not apply prior to the changes. As such, Westin must settle all its outstanding taxes and penalties with the island receiver's office forthwith to avoid any type of actions.
Marlin said he neither any member of his government did not go to the media to discuss this matter and the former commissioner is now trying to create the impression that they (Democratic Party) did all in their power to assist Westin. Marlin called on the island council member Roy Marlin to come clean and tell the people what his government did to the investor. He said Island Council man Roy Marlin said in one media report that the National Alliance/Heyliger/ Laveist government need to stop playing politics and deal with the issue at hand. Marlin said he wants to make clear that his government is currently busy cleaning up yet another mess that was created by the Democratic Party. Marlin said he wants to make crystal clear to the people of St. Maarten that the Democratic Party did not lift up one good finger to live up to their promise to Westin.
Marlin said his government is busy trying to settle this matter in an amicable way and they do not want any type of public fighting since that is not creating a good image for St. Maarten.
Marlin also made clear that his government would not take the blame for the Westin affair not even in the spirit of Christmas. In the meantime, lawyers for the island government and the Westin Resort were locked in a meeting on Thursday night to work out an agreement to stop the planned auction. Should there be an agreement SMN News will update its readers.

Roy was such a disaster.... Sarah was to weak to keep the incompetent ones inline or from messing up. Let's see if William can keep the weaker ones in his crew from making disasters like Sarah's crew of screw ups.

Mr. Roy Malin, I think you got your pants in a weggi this time. I don't always agree with William, but this time Roy he really got you. How can you give Westin a letter of comfort and do nothing to further change the island regulation relating to giving waivers as an incentive. This looks like a Mickey Mouse game. Do you think other investors will take the Island government serious the next time? Maybe 4 years was not enough to gather support for the changes to the regulations. That's the problem with government, they always work at a snails pace.
I'm sure the lawyers will work out something, but I don't think the Westin want to see you or the former executive council anymore. Forget about that contribution for the next election.

West in and other foreign investors are not blinded or amused by political games our politicians play whenever an election is around the corner.

As far as I read, the previous Exco said the same thing to West in as what Marlin is now saying. They did not promise them anything they simply stated what the options would be.

Changes of articles in the Law cannot be done overnight to please any one party. It takes time to insure that whatever changes made are in keeping with the Law and both present and future consequences has to be considered. Then there is always the "opposition" who will do all possible to delay any decisions to be made by the ruling Government.

If changes are so simple to be made then my question is ... Why didn't the present Exco make such changes when West in contacted them?
Word of advise: Stop using people misfortune to boost your campaigns. And this goes for all politicians from any political party. I am tired of these games. Deal with the issues at hand.

Roy had a house in Dawn Beach built by Columbia Sussex (aka Westin) construction crew and then rented it out to the managers of the construction crew (Ray Hicks and red necks alike). This all because Roy "would come through" with what he said in the comfort letter. Westin kept their end of the deal, while Roy just sat back after receiving his upgraded house (now listed for a selling price of $ 1 million by the way) and did not follow through on his end.

What goes around comes around, I guess.

By the way: Roy boasted that the Westin would provide so much work for the local sector. Which commissioner has the balls to verify how many locals are working there now? I'm estimating fewer than 25%.

So now the island has not been receiving any room tax the jobs are being filled by mostly foreigners. Wow, great job Roy!

It is time that the DP govt stay out of office and keep all eyes on what NA do. It is time that you all should look out for your own local people and the country at hart. To the DP party, is this how you are going to take SXM in country status? damm shame. Last - I allways knew that sarah, micheal, roy along wit theo are snakes in the grass. so how come every body blasting roy alone why they we not talking about sarah daughter as former hr director of westin and her son in law as the payroll accountant for westin and that brenda has all the contracts for marketing locked at westin ........... as the saying goes what happens in the dark comes to light and i do agree that less than 25% of locals work at westin they use all kind of screening excuses why the locals don't qualify..they lied to the st maarten people about getting jobs and when asked about transportation they said they would make arrangements after westin in was up and running they said transportation was not up for discussion if you want the job find your way...WESTIN SHOOK THE DEVILS HAND

"Not Stupid", it is obvious that you missed the previous article on SMN News wherein Westin claims what the letter of comfort given to them by the former DP Goverment states, otherwise you would not make the comment that the previous DP Government said the same thing as the NA/Heyliger Government. So please read in the news archive the SMN NewsTuesday edition of this week with the headline "Lien placed by Goverment on Westin Account". As Bling said "WESTIN INDEED SHOOK THE DEVILS HAND" and they are now learning it the hard way because this Government is cleaning up the mess the previous DP Government created.

Shame on the bloggers for entertaining such poor politics...slandering peoples names and all sorts of unnecessary comments. Is this the Country St. Maarten we are projecting? If the DP did not live up to its promises or did wrong, William needs to realize he is LEADER OF GOVT and should get to working other than playing BLAME LAME politics. As far as I read in this article, W. Marlin clearly stated that the previous Exco took the decision not to grant the comfort to Westin since January 2009.
In January 09, the previous exco did not know that NA would be in Govt. in June 09, unless they are psychic. So no foul play was intended to discredit the present Exco as is being insinuated by W. Marlin. (the decision dates are always listed in letters issued by Government which would show that it came from the previous DP Exco).
NOTE: The commissioners do not personally send out the mail, they take decisions and the relevant departments have to insure that those decisions reaches the parties in question. So blame the department head who sent out the letter after the Government had changed, do not blame Roy, the previous EXCO or anyone else. Blame the incompetent civil servants.

Westin contacted him (W. Marlin) personally after they received the letter, which was either June or July 09. What did he tell them, what did he do? Why did he not act on the matter then by putting his decision in writing to them also. Let them go to courts or make an arrangement then. Don't let it sit there, do nothing and have the Receivers put a lien on them. You are playing with peoples livelyhood just to prove some stupid political campaign point. That is the point.

This stupid blame game has to stop and matters are to be dealt with with urgency. Tell me .... what is the difference between the previous and present EXCO? Stop this political blame game and do what you are there to do. Govern the Island and clean up the "so called" mess the previous EXCO made. Don't sit back and destroy this Island any further by pointing fingers.

P.s. I read up on and listened to the press release about Westin. I have a few questions:

1. When did West in commence operations, 2004 or Dec. 2006? 2. Did West in live up to their part of the agreement as listed in the letter of comfort. It clearly stated that the Exco would try to waive the taxes if Westin re-invested those funds into the Island, did they? 3. Was the letter signed by the Previous EXCO after June 8th, 2009? and by whom was it signed? (If signed after the 8th of June 09, by members of the previous EXCO, why were no charges brought against them (previous exco) by the present EXCO)? 4. Did Roy ask William to live up to the letter of comfort or did he request that the present EXCO stand up to West in as he (Roy) did or do something about the ordinance and shut up with the finger pointing?

My final comment on this issue is that I find the letter drafted by the previous EXCO quite clear to the point and that no concrete promises were made to Westin. West in was also clearly notified to make payments or face the consequences. Could it be that the previous EXCO got tired of West in not living up to their commitments and decided to stop the B.S. and deal harshly with them?. Until otherwise proven I will support the actions taken by the PREVIOUS EXCO.
Will the present EXCO let them get away with the taxes if no concrete proof of re-investment is shown? Come on W. Marlin, do like the previous EXCO and stand your grounds.

Never again to return to Government. William always beings it out likle it is. That is why sometimes some people find that he is arrogant, but he tells it like it is. If it can happen, he makes it happen, and if your request is impossible, then that is what he will tell you. Some people do not like to hear the truth/ They prefer that people lilke Sarah and them keep fooling them. In order to get back favors, Sarah and them also cannot say no to these big shots. Again I say that is why they are out for good.

You see how simple minded people think. While I am flattered that you believe it is Sarah posting my comments, it just proves how simple some people are and just cannot imagine that there are people out there who look at the situations and pick sense out of none sense.

Anyhow, as I said before, it is time for William and his Exco to get serious and understand that you can fool only a handful of people all of the time. I have high regards and respect for William as an individual but he has to get serious and step up to the plate as a politician and leader of Government. Spend less time in the media lamenting on what the DP has done wrongly and do your job, which is to Govern this Island, clean up the messes as soon as possible and solve or resolve the issues at hand. We will surely notice if you have achieved anything positive and if DP indeed were so bad.

He always makes the same mistake each time there is election by wasting time on letting us know all the bad DP has done.
Then he always end up making the DP party look good and then they (DP) end up winning the elections. Put some positive mileage on whatever time you are in Government. Your profile is empty so far. Concentrate on what you can do and or make happen and then do it.
