13 year old Among Robbers --- Appeared in Court on Friday.

13year29082009Philipsburg: --- A 13-year-old boy who is not capable of reading and writing has been in police custody for the past three days. The youth is known for running away from home.

In an interview with SMN News, his mother Myrtle Nicolas said police told her, that her son Marwin Vallet was with some other boys at the Atlantis Casino picking up donations under false pretence.

She said police did not share much information with her but they said the young man committed fraud since he was picking donation for a basketball foundation. Nicolas said police said her son and some other boys who managed to flee from police collected donations from several places and were caught at the Atlantis Casino where they allegedly ran away with a computer and a phone.

The single parent said she has been facing several challenges with her son whom she described a slow learner and one who cannot even read or write properly. Nicolas said she tried seeking psychological help for the youth but that too is a challenge. The woman said she left her son at home, by locking him inside the house and he took his sister keys out of her bag and left. She said she did not file a missing person report because she had to wait until 24 hours elapsed but before that police contacted her saying, she should bring clothes and a towel for him.

Chief Prosecutor Hans Mos said the young man was held for some sort of theft, he was in a car with some other boys who managed to run away, however, police is holding him as long as necessary to conduct their investigations. Mos confirmed the young man was taken to court for an extension of time.

Asked if it is practical to have a 13 year old locked up in an adult prison and if it is normal that he be shackled to an adult, Mos said police is allowed to arrest anyone over the age of 12 years. While those 12 and under is not punishable by law, a 13 year old can be held like any other person. He said while it is not correct to hold juveniles with adults, there is nothing else the police can do since there are no separate cells for juvenile at the police station or at the Pointe Blanche Prison.

I feel that if there is NO cells for juveniles at the point blanche prison, than at least lock him up in a cell that are use for government officials, but not among adult prisoners,that's WRONG AND SHAMEFULL.

I hope Government can do something about this ASAP. Mr Mos should'nt make such statements, because the boy is under age (1smilies/cool.gif and should be placed in a juvenile section or sent to Curacao school correction temporary. He is not Mr. Mos child, friend child or nephew, so he don't CARE!! He know's if this was Holland it would have never happen, but why in St. maarten!!

I somewhat agree with you but everything else is happening in sxm. Sometimes they need to feel the reality of thesituation for them to change their acts.
This tiime a weapon wasnt used but who knows the other time it might!

There is nothing wrong with Mr Mos' statements. On the other hand. You Big Fish seem to know Mr. Mos so well to state that he does not care, and taking it personal. He is telling you exactly how the situation is. Why get personal.?
The young man as the mother stated is a slow learner. But was quick to take his sister keys and leave his home, contrary to what his mother wanted. Had he stayed at home we would not be discussing this 13 year old

It is a shame that this mother don't care about her children, if she had, she would take time for them and help them cause everyone of us has children like this. The difference is the kind of love you give your children by spending time with them, taking them out, and making them happy. Not only feeding them and buying expensive shoes and clothes and making them beleive that you did everything for them : that is not love. And now trying to make us beleive that this child is doing what he wants, it's your responsibility to take care of your children.
An now your child is prisonned with a rapist of a 10 year old, Are you happy about that ?. What will become of that little boy?

And the responsible for this picture should be locked up for putting an under age child in this announce, you should reed and learn more about the law. You do not have the right to divulge a minor picture eighter in news papers or TV.

Mr Mo's has no right to locked of a child 13 years with adults, mostly rapist an he knows it. He is making an exemple of this one, when that same child will be raped by all those prisoners, I hope that he will be able to live with that.

It's not about getting personal, it's just the FACTS!! Mr. Mos has to look for a solution, and don't make statements like there is nothing else police can do, but lock up an juvenile with adults!!If it's not allowed in Holland WHY SXM??

Not to take up space by accepting comments that does not have any significance to the topic .

Every individual has their freedom of opinion yes.
But we should educate ourselves before we give hollow comments.

I agree with Big Fish totally! Do you really think that locking up this teen with adults will get him better! On the contrary, he will be given lessons in jail on how to go further!
There is something called foster homes or juvenile homes! On the french side there is a special home for children as such ! even at a temporary solution! A child cannot be with adult convicts!
I do agree with him also if it was some big person son it would have been different weither you like it or not!!!!

Look what our island has come to.
This is very shameful, where are we going with things like this.
Children being shackled and taken to courts with adults.
I agree with one of the abovementioned comments.
A child, although he did wrong is still a child, and the case according to my knowledge is heard behind closed doors.
Well from my knowledge that is what happened in the past.
Although I agree that putting him behind bars might give him a reality check, I dont think that he needs to be sheckled with someone suspected of rape. Where are we going ppl.

It is about time that the issue of these young boys hara*sing people for donations outside supermarkets and parking lots come to light.
Many times I have been approached by these young boys asking for money and I tell them the same thing... as long as they do not have a paper with a stamp from economic affairs allowing them to collect money.... they are committing fraud.
As for Mr.Mos statements... he is not the one that have to look for a solution, the solution lies with the parents and the elected officials as well as the Minister of Justice. Mr.Mos is simply carrying out his work to the best of his ability and with the resources he has at his disposal.

Do you work? Are you from here? if the second question is yes then you would not know what a foreigner has to do to make sure people like you are paid at the end of the month for the shacks you people rent to foreigners. The woman I am sure is single, because the local man she make her children for is not supporting them and neither is he in their lives.(some scenarios for you to think about)
Second she has to be working for XXXX amount of monies before the labor and residency permit law allow her to have legal documents to reside here and grant her children residency, even though she maybe doing the job people like you reject. So yes while she may want to spend time with her child her children she is not able to because there is no Social Welfare or rents from shacks for her to depend on.
The people to blame here is those that falsified a document for him to collect donation. The prosecutor and police should try to see who is really behind the scheme because clearly he is an illterate and not able to produce the document himself.
As for locking him up with adults and shackling him to a suspected rapist I am sure is okay because he is not LOCAL or better yet "I from here".

I am a mother of 2 - 12 & 14 years old, married for 21 years now. I am a St martiner, and work 8 hours a day, 5 days a week. I started to work at 19 years old and don't tell me that a mother can't find time to educate her children. It seems that we have a real problem on this island. You all make children so young and when it come to educating them, you don't know how it works. Education comes from home and from a very young age so a child can grow up with rules and respect toward others and mostly to themselves. It's not at school or from others. Don't tell me that you can't find time lo learn a child the basics of reading and writting, mostly if your child present difficulties. It work on locals and also foreigners, every country have the same rules when it comes to education.
It's a shame you have this problem also.

I think none of you don't understand
after reading this story, I have come to the conclusion that this child has a mental disability. Maybe a form of autism, I don't know since I am not a psyciatrist, but I am a mother of a child with a disability (autism) and I have had to fight the system in SXM since we are still in denial in sxm that these disabilities exist. I have struggled for 5 yrs to find out what my child's problem was and have had to move to the Netherlands for my
child to get help. And that is a great sacrifice but at least they (netherlands) care about people with disabilities. I sympathize with this mother.

TO THE MOTHER OF THIS CHILD
Please find out what you son's problem is. If you don't fight for him no one else will.

this young man need special help putting him behind bars won't help him. he will get worst. so all of you who so care try and help not only him but others like him. you have piece of land give it to the government or you yourself build a place were these kids can get the right type of help. that the only way we can help our kids don't mater were they are from here or not. because in the long run it we they will try and hurt or hurt.

Its very interesting that a boy that is a slow learner, or boy that can not read or write ...or as a blogger suggest that he might have autism, just imagine that a 13 year old who has all thos deficiencies or problems was able to put a donation list together to pick up money......its either that he is the smartest slow learner or he is the smartest iliterate person that there is.....or that some adult is behind that scheme.....
