PHILIPSBURG:--- On September 26 the people of St. Maarten will go to the polls to elect a new parliament. The different political parties contesting the elections will try to obtain as many votes as possible to be represented in the new parliament.
Participating in the elections is an important acquired right that in some parts of the world does not come automatically. Free and fair elections where the vote is cast anonymously, form the basis of the democratic rule of law. The importance of this is anchored in the Constitution and in international treaties. A voter has the right to cast his vote without being influenced and to keep this decision to himself.
An example that elections do not always proceed in a fair manner is the buying or selling of votes, be it for cash or other personal favors/promises. Contrary to electoral promises to the population as a whole, promises to individual citizens are not allowed.
Bribery in suffrage is punishable under Article 2:44 of the Penal Code of Sint Maarten (previously article 132 of the Penal Code of the Netherlands Antilles). Recently the penalization has been increased to imprisonment of two years. It is also possible that a person convicted of bribery can be deprived of certain rights. This may include that a convicted person may no longer vote or that he may not stand for election.
What is bribery according to the Penal Code?
To proof this offense it is sufficient that parties agree on not voting or voting in a
particular way by accepting a gift or a promise. It is as if people (verbally) reach an agreement. Both the person making the gift or promise as the one who accepts the offer are punishable. That afterward the gift or promise is not redeemed or that the actual voting occurs differently than agreed upon, does not matter.
An attempted bribe is also punishable by law. This is the case when a gift or promise is offered, but the other party does not wish to cooperate.
Both the completed offense as the attempt thereto must be based on an individual
'favoring' of the voter or his representative. It is needless to say that “campaign
material” such as pens, buttons, t-shirts etc. with the logo of a political party are not considered as commitments to any individuals.
Around every election, however, the Prosecutor’s Office receives indications that voters are bribed to cast their vote for a particular party or person. This affects the free and fair conduct of the elections.
The Prosecutor’s Office will be extra vigilant during the period until the elections for indications of bribery and will investigate these. The Prosecutor’s Office has also met with the Main Voting Bureau to discuss all circumstances, in general, surrounding the elections.
OM alert op stemfraude
Op 26 september 2016 vinden de verkiezingen plaats voor het nieuwe parlement van St. Maarten. De verschillende politieke partijen zullen campagne voeren om zoveel mogelijke stemmen te behalen, om op die manier vertegenwoordigd te worden in de Staten.
Deelnemen aan de verkiezingen is een belangrijk verworven recht, dat in delen van de wereld niet vanzelfsprekend is. Vrije en eerlijke verkiezingen waarbij de stem anoniem wordt uitgebracht staan aan de basis van de democratische rechtstaat. Het belang hiervan is in de Staatsregeling en in internationale verdragen vastgelegd. Een kiezer heeft het recht om zonder enige beïnvloeding zijn stem uit te brengen en de inhoud van zijn keuze voor zichzelf te houden.
Een voorbeeld dat verkiezingen niet altijd op een eerlijke manier verlopen is het kopen of verkopen van stemmen, het zij met contant geld of door andere gunsten/beloftes. Toezeggingen op individuele niveau, aan individuele burgers, zijn echter niet toelaatbaar. Dit in tegenstelling tot toezeggingen aan de bevolking als geheel, de zogenaamde verkiezingsbeloften (aan het land).
Omkoping bij kiesrecht is strafbaar gesteld in artikel 2:44 van het Wetboek van Strafrecht van Sint Maarten (vroeger artikel 132 van het Wetboek van Strafrecht van de Nederlandse Antillen). Recent is de strafbaarstelling verhoogd naar een gevangenisstraf van twee jaar. Tevens is het mogelijk dat iemand die veroordeeld wordt voor omkoping wordt ontzet uit bepaalde rechten. Dat kan inhouden dat een veroordeelde niet meer mag stemmen dan wel dat hij zich niet meer verkiesbaar mag stellen.
Wanneer is sprake van omkoping conform het Wetboek van Strafrecht? Voor de voltooiing van dit delict is het voldoende dat partijen overeenstemming bereiken over het niet of op een bepaalde wijze stemmen door een gift of een belofte te accepteren. Als het ware sluiten mensen met elkaar (mondeling) een contract af. Zowel degene die de gift of belofte doet als degene die het aanbod accepteert zijn strafbaar. Dat daarna de
gift of belofte niet wordt ingelost dan wel dat er toch anders wordt gestemd, maakt niet uit.
Ook een poging tot omkoping is strafbaar. Daarvan is sprake als een gift of een belofte wordt aangeboden, maar de andere partij niet mee wenst te werken.
Zowel bij het voltooide delict als bij de poging moet sprake zijn van een individuele
'bevoordeling' van de kiezer of zijn gemachtigde. En het zal een ieder duidelijk zijn dat
‘campagnemateriaal’ zoals pennen, buttons, t-shirts etc met het logo van de politieke partij, geen toezeggingen zijn.
Rond elke verkiezing bereiken het Openbaar Ministerie (OM) in St. Maarten signalen dat kiezers zich laten omkopen om hun stem op een bepaalde partij of persoon uit te brengen. Dit beïnvloedt een vrije en eerlijke verloop van de verkiezingen.
Het OM zal gedurende de periode tot aan de verkiezingen extra oplettend zijn op signalen van omkoping en deze onderzoeken. Het OM heeft tevens met het Hoofdstembureau gesproken over alle omstandigheden in het algemeen omtrent de verkiezingen.
