SABA:---The man who has been arrested on suspicion of involvement in the death of the student who was found in April on Saba, has been released on July 27th, 2015.
However the Prosecution considers him still as a suspect. The evidence on which he was previously in custody is still valid, according to the Prosecutors Office.
On three previous occasions the magistrate issued an injunction to keep the man in custody, however this time he did not extend the suspect’s custody. Because the previously issued warrant to detain the suspect ended on July 27, the Prosecution has no legal basis to detain him any longer.
The investigation is far from over.
First the police and the Prosecutors Office continues to search for witnesses who can give any information about what happened that night or what the defendant did that night. The investigation team has indications that there are witnesses who have not yet told everything they know about this case, but these witnesses have still not spoken with the police.
In addition, the forensic investigation is still in progress. There are traces being examined by the Dutch Forensic Institute, among other useful DNA information. Many research results leads to new questions which lead to further investigation. Also, it is often necessary after the release of results. to conduct additional interviews with witnesses to interpret the results.
Under these circumstances, no final conclusions can be drawn on the circumstances. Because the suspect denies that he has anything to do with the death and the research does not give definitive conclusions, the judge has decided that the evidence in this case no longer justify the detention of the suspect. By this, the investigating judge shows a different interpretation of the case than the Prosecutors Office .
The Prosecution considers this decision of the magistrate also as a setback but stressed that the investigation is obviously continuing.
Also, as was the case up until now, not only the option will be investigated that the now freed suspect acted alone, but also other scenarios are still being investigated.
The cooperation with the authorities in Canada and the United States remains unchanged. Now, under the new circumstances, there is a revision of which additional investigation resources and detectives are needed. The Public Prosecution is still working with the Prosecutors Office in the Netherlands.
Public Prosecution and the police cannot give information about the whereabouts of the suspect after his release.
Verdachte in onderzoek Hector niet langer in detentie
De man die eerder is aangehouden op verdenking van betrokkenheid bij de dood van de studente die in april werd aangetroffen op Saba is op 27 juli op vrije voeten gesteld.
Het Openbaar Ministerie beschouwt hem nog steeds als verdachte. De aanwijzingen op basis waarvan hij eerder in voorlopige hechtenis zat, zijn volgens het OM nog steeds aan de orde.
De rechter-commissaris die eerder drie maal een bevel uitvaardigde om de man in voorlopige hechtenis te houden, heeft die bevelen niet verlengd met een nieuwe termijn. Omdat het eerder afgegeven bevel om hem gevangen te houden op 27 juli afliep, heeft het OM geen juridische basis meer om hem langer vast te houden.
Het onderzoek is nog lang niet afgerond.
Allereerst proberen politie en OM nog steeds om getuigen te vinden die iets kunnen verklaren over wat er die nacht is gebeurd of wat de verdachte die nacht heeft gedaan. Het onderzoeksteam heeft aanwijzingen dat er getuigen bestaan die nog niet alles wat zij weten hebben verteld, maar deze getuigen hebben zich nog steeds niet gemeld.
Daarnaast is het forensisch onderzoek nog in volle gang. Nog steeds worden sporen door het Nederlands Forensisch Instituut onderzocht, onder andere op bruikbare DNA-informatie. Veel onderzoeksresultaten roepen weer nieuwe vragen op die dan weer tot nader onderzoek leiden. Ook is het vaak nodig om na het beschikbaar komen van onderzoekresultaten die resultaten op basis van aanvullende getuigenverhoren te kunnen interpreteren.
Onder die omstandigheden kunnen nog geen definitieve conclusies worden getrokken over de toedracht. Omdat de verdachte ontkent iets met de dood te maken te hebben en de onderzoeksresultaten nog geen definitieve conclusies mogelijk maken, heeft de rechter-commissaris besloten dat het bewijs in het dossier niet langer de voorlopige hechtenis rechtvaardigt. Daarmee geeft de onderzoeksrechter blijk van een andere interpretatie van het dossier dan het OM.
Het Openbaar Ministerie beschouwt deze beslissing van de rechter-commissaris dan ook als een tegenslag maar benadrukt dat het onderzoek vanzelfsprekend wordt voortgezet.
Daarbij wordt net als dat tot nu toe het geval was, niet alleen de optie onderzocht dat de nu vrijgelaten verdachte als enige betrokken is, maar worden ook andere scenario’s open gehouden.
De samenwerking met de autoriteiten in Canada en de Verenigde Staten blijft ongewijzigd. Onder de nieuwe omstandigheden wordt nu bekeken welke onderzoeksmiddelen en rechercheurs er extra nodig zijn. Het Openbaar Ministerie werkt nog steeds samen met het OM in Nederland.
Openbaar Ministerie en politie kunnen geen mededelingen doen over de verblijfplaats van de verdachte na zijn vrijlating.
